The Small Business Council sent a letter SBA Chief Counsel for Advocacy Winslow Sargeant outlining our opposition to HR 3309 and other proposed patent reform legislation that would weaken patent protections and make it proportionately more difficult and onerous for small businesses to legally defend their patents.
The bill ostensibly is targeted at “patent trolls”, entities that attempt to enforce patent protections on technologies without any intention of manufacturing or producing the technology that is patented. Unfortunately the legislation in question does not even distinguish between “patent trolls” and productive small businesses, lumping them all in the same category and in effect devaluing small business patents.
